§ 91.01  ADOPTION OF RULES AND REGULATIONS.

The following sections of this chapter shall govern the use of a lake containing approximately 200 acres located about two miles west of the city known as "Sympson Lake", which is under the control of the city.  They shall also govern the use of the land surrounding the lake that is owned by the city.  (Ord. 83, passed 12‑11‑73)

§ 91.02  USE AND PRIVILEGE.

The city assumes no responsibility for any use of Sympson Lake except the maintenance, control, and operation of same as a principal part of its water department and distribution system and where other uses are permitted, such uses shall be deemed a strict privilege.  The city assumes no responsibility whatsoever for loss, injury, or destruction to persons or property, whatever the cause, because of the exercise of such privilege which shall be subject to revocation at anytime without notice and without payment of compensation or return of any fee.  (Ord. 83, passed 12‑11‑73)

§ 91.03  REGULATIONS AND LIMITATIONS.

All persons exercising any privilege in or upon Sympson Lake, when the privilege is permitted and authorized together with all vehicles, boats, and equipment used in connection with the exercise of the privilege shall be subject to all regulations, limitations, restrictions, and penalties hereinafter contained or hereafter passed.  All of which shall be subject to inspection at all times.

§ 91.04  BOATS AND BOATING.

(A)  No boat shall be launched or operated except those licensed and equipped in accordance with state laws and regulations.

(B)  No boat shall be launched or removed except at those locations designated from time to time for that purpose and loading and unloading of boats and passengers shall be limited in time to five minutes.

(C)  No boat shall be greater in length than 20 feet and no motor of greater horsepower than 200 horsepower (as determined from the factory name plate rating of all motors) shall be permitted.

(D)  No boat shall be permitted to remain in the water unattended overnight.

(E)  No person under the age of 16 years shall operate a boat on the lake unless accompanied by a person 16 years or older.

(F)  No boat shall be operated in a careless, negligent, or such manner as to constitute a danger to persons or property.

(G)  No boat shall be operated without more passengers than is reasonably safe considering existing circumstances and no more than six persons shall occupy any boat at anytime.

(H)  No boating above wake speed shall be permitted in any area, between official sunset of each day and 10:00 a.m.; when entering or departing a launching area; or in Rodgers Run Branch or other area so marked.

(I)  No hydroplanes or racing boats or hulls shall be allowed on the lake at anytime.

(J)  No boat shall be permitted upon the lake without a permit issued.

(K)       No boat shall exceed thirty-five (35) miles per hour on Sympson Lake.

§ 91.05  RESTRICTED AREA.

(A)  No boating shall be permitted in any area designated as a restricted area.

(B)  No boat shall be operated within 200 feet of any dam forming a lake or spillway.

(C)  No skiing or boating shall be permitted on Rodgers Run Branch, this area is restricted to fishing only.

§ 91.06  SKIING.

No person shall engage in water skiing unless two persons of age of 16 years or more are in the boat towing such skier.   Skiers shall wear life jackets of a type approved by the U.S. Coast Guard.

§ 91.07  ALCOHOLIC BEVERAGES, CONTROLLED SUBSTANCES; FIREARMS; AND DRUGS.

(A)  The use and possession of alcoholic beverages and controlled substances (drugs) in or upon the lake or municipally owned property is prohibited.

(B)  Subject to the provisions of KRS Chapter 237, no persons, except duly authorized law enforcement officers actually engaged in the performance of their duties, shall take, carry or possess firearms or permit the same to be taken, carried, or otherwise possessed in or upon Sympson Lake or municipally owned property surrounding the same.

§ 91.08  LITTERING.

Any person or persons found guilty of littering upon the lake, lake property, or roads leading thereto shall be subject to a fine of not less than $25 nor more than $300.

§ 91.09  FISHING.

(A)  All persons shall possess a state fishing license.

(B)  All state fishing regulations shall be applicable.

(C)  No fishing shall be permitted from the dam or spillway.

§ 91.10  SWIMMING AND PICNICKING.

(A)  Swimming in the lake, except that which is directly connected with the act of waterskiing, is prohibited.

(B)  Picnicking on municipal property, except in those areas designated for that purpose by appropriate sign is prohibited.

§ 91.11  BOATING PERMITS.

(A)  No person or persons shall launch any boat upon the lake without first obtaining an appropriate boat permit from the city, which shall be issued at City Hall during regular business hours.

(B)  Fees for permits.

(1)  Boats without motors or boats with electric motors, which shall include fishing privileges for all occupants:

County residents                             $10 per year
Nonresidents                                          25 per year

(2)  Boats with motor of 10 HP or less, which shall include fishing privileges for all occupants (issuance of this permit shall be limited to 125 permits for each calendar year)

County residents                             $15 per year
Nonresidents                                                30 per year

(3)  Boats with a motor in excess of 10 horsepower but not more than 85 horsepower, which shall include fishing privileges for all occupants (issuance of this permit shall be limited to 145 permits for each calendar year)

County residents                             $35 per year
Nonresidents                                                70 per year

(4)  Boats with motors in excess of 85 horsepower but not more than 200 horsepower, which shall include fishing privileges for all occupants (issuance of permits shall be limited to 25 per calendar year):

County residents                             $50 per year
Nonresidents                                                100 per year

(5)  All county residents over 65 years of age shall be given free boating and fishing privileges.

(6)  All licenses shall expire on December 31, of each year and shall be non-transferable.

§ 91.99  PENALTY.

Any person violating any provision of this chapter for which no other penalty is provided shall be deemed to have committed a violation and shall be subject to a fine of not less than $25 nor more than $100 for each offense, and any person convicted of such violation shall not be permitted on the lake or the city property surrounding the lake for a period of 30 days following such conviction, and all violations of the regulations herein pertaining to boating shall be reported to the Kentucky Division of Boating.
